Welcome to Nostalgic Cloud9 Studio (“NC9 Studio”, “we”, “our”, “us”). These Terms & Conditions govern the use of our website and photography services. By accessing our website or booking our services, you agree to these Terms.

1. Booking Confirmation

A booking is confirmed only after:

  • Acceptance of the quotation or service agreement.
  • Payment of 50% of the total package amount as a non-refundable booking advance.
  • Confirmation of the event date by NC9 Studio.

Until the advance payment is received, the requested date remains available for other bookings.

2. Payment Terms

  • 50% advance payment is required to secure the booking.
  • The remaining 50% balance must be paid on or before the event date, unless otherwise agreed in writing.
  • Deliverables may be withheld until all outstanding payments are received.

3. Project Delivery

NC9 Studio will make reasonable efforts to deliver the final edited photographs and videos within 60 calendar days from the event date, provided:

  • All payments have been completed.
  • Required selections (such as album images) are submitted by the client on time.
  • No unforeseen circumstances beyond our reasonable control delay production.

Delivery timelines may vary for premium albums, additional edits, or custom products.

4. Cancellation & Refund Policy

By the Client

  • The 50% booking advance is non-refundable, as the event date is reserved exclusively for the client and preparation work begins upon confirmation.
  • If additional payments have been made beyond the booking advance:
    • Cancellation 30 days or more before the event: any amount paid above the non-refundable advance may be refunded after deducting expenses already incurred.
    • Cancellation within 30 days of the event: refunds, if any, will be determined after deducting costs, commitments to vendors, and work already completed.

If NC9 Studio is unable to perform the services due to circumstances within our control, we will either:

  • Offer an alternative date (subject to availability), or
  • Refund payments received, excluding amounts already spent with the client’s prior approval or for completed work.

5. Rescheduling

Requests to reschedule are subject to:

  • Written notice.
  • Availability of the new date.
  • Additional charges, if applicable.

If the requested date is unavailable, the booking may be treated as a cancellation under this policy.

6. Client Responsibilities

The client agrees to:

  • Provide accurate event details and schedules.
  • Obtain any required permissions for photography or videography at the venue.
  • Ensure timely cooperation from participants.
  • Inform NC9 Studio of any special photography restrictions before the event.

7. Copyright & Portfolio Usage

Unless otherwise agreed in writing:

  • Copyright in all photographs and videos remains with NC9 Studio.
  • Clients receive a personal, non-commercial licence to use the delivered content.
  • NC9 Studio may use selected photographs and videos for its portfolio, website, social media, and promotional materials where client consent has been obtained or where permitted by the service agreement.

8. Limitation of Liability

While every reasonable effort is made to deliver high-quality services, NC9 Studio shall not be liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government restrictions, venue limitations, equipment failure despite reasonable precautions, illness, or other force majeure events.

9. Website Use

Users agree not to:

  • Misuse or interfere with the website.
  • Copy, reproduce, or distribute website content without written permission.
  • Upload unlawful or harmful material through the website.

10. Privacy

The collection and processing of personal information are governed by our Privacy Policy and applicable Indian laws, including the Digital Personal Data Protection Act, 2023.

11. Governing Law

These Terms & Conditions are governed by the laws of India.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Tirupati, Andhra Pradesh.
